These draft terms govern use of the Business Asset Buyer website and submission of potential commercial opportunities.
No obligation to purchase or sell
Submitting an opportunity, registering as a buyer, discussing property, requesting information or receiving an indication of interest does not create an obligation to purchase, sell, finance, transport or complete a transaction. Any binding transaction requires mutually agreed final terms and any required verification or approvals.
Accuracy of submissions
Users must provide information that is accurate to the best of their knowledge and must not knowingly misrepresent ownership, authority, condition, quantity, authenticity, location, liens, claims, restrictions or other material facts.
Lawful authority
Anyone offering property must own it or have lawful authority from the owner or controlling party to offer it. Special circumstances such as secured collateral, warehouse liens, receiverships, insurance claims, customs/bonded goods, estates or court proceedings may require additional documentation or approvals.
Prohibited property
Business Asset Buyer does not knowingly purchase stolen, unlawfully obtained or counterfeit property. We may decline regulated, restricted, unsafe or otherwise unsuitable goods, or require additional legal/regulatory review.
Intermediaries
Brokers, resellers and other intermediaries must accurately disclose their role and, when requested, identify the actual owner/controller and demonstrate authority to present the opportunity.
